Kochi: The High Court bench of Justice A Badharudeen ruled that simply sending messages and making calls to a minor without any sexual intent does not violate the Pocso Act. They dismissed a Pocso case against a 24-year-old man who had been accused of causing distress to a 17-year-old girl by contacting her through messages and calls. The prosecution had charged the man with stalking and sexual harassment but the court found that there was no evidence of sexual intent in the messages or calls. The petitioner presented an affidavit from the victim stating that the matter was settled, but the prosecution argued against dropping the case. Ultimately, the court emphasized that Pocso offences require evidence of sexual intent, which was not present in this case.
